Purchasing Firearms or Ammunition
1.0 Licensing Requirements
All transactions involving firearms, ammunition, or related components are conditional upon the customer providing a valid, current firearms license issued under Irish law. Failure to furnish such documentation at the point of sale or delivery shall render the contract void.
1.1 Contract Formation
By engaging in a sales or storage agreement with Ballykeeran Sport Co. (“the Company”), the customer expressly agrees to abide by these terms. The Company reserves the unilateral right to amend terms, with prior written notice (via email or post) to the customer’s provided contact details.
1.2 Order Cancellation by the Company
The Company may cancel any order at its sole discretion, issuing a refund equivalent to the lesser of the deposit paid or the full purchase price. Such cancellations shall not incur additional liability beyond the refund amount.
1.3 Governing Law
All transactions are subject to the laws of the Republic of Ireland, including the Sale of Goods Act 1893, Firearms Acts, and applicable EU regulations.
2. Firearm and Ammunition-Specific Provisions
2.1 Licensing Contingency
Sales of firearms and ammunition are contingent upon the customer obtaining a valid license for the specific item(s). If a license is not secured within four (4) months of sale, the Company may relist the item(s) for resale. Should the customer later obtain a license, the Company will supply an equivalent product (subject to availability) but assumes no liability for stock shortages.
2.2 License Refusal or Delay
If a license is denied or delayed beyond six (6) months:
- The Company may cancel the order, refunding the deposit minus a 15% administrative fee.
- For custom orders (e.g., specialized ammunition or firearms), the Company will attempt to resell the item(s) on the customer’s behalf, deducting commission and costs before remitting any balance.
2.3 Deposit Cancellations
Deposits are subject to a 15% cancellation fee once a serial number is allocated (firearms) or order is processed (ammunition), covering administrative and holding costs.
3. Returns & Refunds
3.1 General Returns
- Unused Items: Returns for refund or credit must be initiated within 14 days of delivery. Items must be unused, in original packaging, and accompanied by proof of purchase.
- Ammunition Returns: Due to safety and regulatory restrictions, ammunition sales are final unless proven defective (see §3.2). Opened or partially used ammunition cannot be accepted for return.
- Extended Credit: Returns after 14 days (up to 30 days) are eligible for store credit only.
- Restocking Fee: A fee may apply for incomplete packaging or damage.
3.2 Defective Goods
Defects will be addressed per statutory rights under the Sale of Goods and Supply of Services Act 1980:
- Firearms: Repaired or replaced at the Company’s discretion, subject to licensing restrictions.
- Ammunition: Defective ammunition must be returned unused in its original packaging for evaluation. If confirmed defective, a replacement or refund will be issued. Do not return live ammunition without prior authorization – contact the Company for safety instructions.
3.3 Exclusions
- Non-Returnable Items: Custom orders, clearance/discontinued items, ammunition (except as per §3.2), and labor charges are final.
- Shipping Costs: Customers bear return shipping expenses; original free shipping costs may be deducted from refunds.
4. Export Sales
Export orders of firearms or ammunition require valid Irish export permits and destination-country import permits, which are the customer’s responsibility. The Company bears no liability for delays or penalties arising from non-compliance.
5. General Provisions
- Amendments: Policy updates will be communicated in writing. Continued use of services constitutes acceptance.
- Statutory Rights: This policy does not diminish statutory consumer rights.
- Jurisdiction: Disputes fall under the exclusive jurisdiction of Irish courts.
Note:
- This policy aligns with Irish and EU consumer law (Directive 2019/771) and firearms/ammunition regulations (e.g., EU Directive 2021/555).
- Ammunition is exempt from standard distance-selling cancellation rights under EU Directive 2011/83/EU (Annex II).
